Upcoming Webinar: How the America Invents Act Increases the Importance of Trade Secrets

In Seyfarth’s fourth installment of its 2013 Trade Secrets Webinar series, on Tuesday, April 16, 2013, at 12:00 p.m. Central Standard Time, Seyfarth attorneys Jim McNairy, Michael Baniak, and Joseph Walker will address how the America Invents Act impacts the value of trade secret and patent protection, and what the implications may be for technology innovators.

The Seyfarth panel will specifically address the following topics:

  • Determining whether your innovations qualify for trade secret or patent protection or both.
  • The trade secret and patent implications of the “first to file” and “prior commercial use” changes under the America Invents Act.
  • Considerations on how to establish your position for the expanded “prior commercial use” defense, and the potential shortcomings.
  • Considerations for protecting the potential for patent application filing while taking advantage of trade secret best practices – having your cake and eating it too.
